JAWS Data Disclaimer

The FAA provides and the USER hereby accepts the JAWS data subject to the following terms and conditions:

1. Data Definition. The Juneau Airport Wind System Data (“JAWS Data”) is the data created and provided from the JAWS system hardware and software which gathers real-time meteorological data from sensors located in the Juneau area, processes that data into estimations of current levels of turbulence, and distributes meteorological data and turbulence alerts via both directly connected display consoles and displays remotely connected by the Internet, on an as available basis.
2. No support. The FAA does not provide maintenance, support, continuing operation, or consulting services for the JAWS Data unless otherwise agreed to by the parties in a separate writing.
3. Limitation of Liability and Disclaimer. The user assumes the entire risk related to its use of this data. The Government is providing this data "as is" and disclaims any and all warranties, whether express or implied, including (without limitation) any implied warranties of merchantability or fitness for a particular purpose. In no event will the Government be liable for any direct, indirect, incidental, consequential, special or exemplary damages or lost profit resulting from any use or misuse of this data.
4. Interruption of Service. The FAA may interrupt or deny access to the JAWS Data/Information for any reason, including but not limited to: operational necessity; safety or security concerns; hardware or software failure; the need for the JAWS Data/Information no longer exists; the FAA no longer has funding available for its obligations in connection with this JAWS Data/Information.
5. Availabilty. The FAA does not guarantee the continued availability of the JAWS Data/Information, and assumes no responsibility nor retains any legal obligation or liability due to any interruption or denial of access to the JAWS Data/Information.
6. Miscellaneous
   1. Products based on the JAWS Data/Information are not guaranteed, sponsored, recommended, warranted, or endorsed by the FAA.
   2. JAWS data is advisory in nature and must not be construed to dictate specific actions predicated upon the advisory.
   3. The FAA may modify the content of the JAWS Data/Information (including weather products and data elements) at any time.
   4. Users should be sure to compare the data time stamp on the webpage against the current time to determine the age of the data.
